1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the BROAD BUSINESS website, platform, and services (collectively, the "Service") operated by BROAD BUSINESS ("we," "us," or "our").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Eligibility

To use our Service, you must:

• Be at least 18 years of age
• Hold a valid real estate license in your state of operation (for realtor accounts)
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Comply with all applicable local, state, and federal laws

3. Service Description

BROAD BUSINESS provides a real estate business acquisition platform that delivers exclusive, intent-verified prospects to licensed real estate realtors. Our services include prospect generation, data enrichment, realtor profile management, and related analytics tools.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice or liability.

4. Prospect Exclusivity

All business opportunities delivered through the BROAD BUSINESS platform are exclusive to the assigned realtor. We guarantee that each prospect will not be sold or distributed to any other realtor on our platform. However, we cannot guarantee that the prospect has not been contacted by realtors outside our network.

Prospect exclusivity applies from the moment of delivery. If a prospect is found to be a duplicate (same contact delivered to you previously), you may request a credit within 7 days of delivery.

5. Subscription Plans and Pricing

BROAD BUSINESS offers multiple subscription tiers (Starter, Professional, Elite) with varying features and pricing. Current pricing is displayed on our website and may be updated from time to time.

• Starter: Free tier with limited business opportunities per month
• Professional: Monthly subscription billed at the current published rate
• Elite: Custom pricing based on team size and requirements

Professional tier subscriptions are billed monthly. You may cancel at any time with 30 days written notice. Elite tier agreements may have custom billing terms as specified in your individual service agreement.

6. Refund Policy

We offer a 60-day satisfaction guarantee for Professional and Elite tier subscribers. If you are not satisfied with the quality of business opportunities received, you may request:

• Additional prospect credits to replace unsatisfactory business opportunities
• A full refund of your subscription fee
• Individual prospect credits for verified invalid business opportunities (wrong number, duplicate, etc.)

Refund requests must be submitted within the guarantee period. We reserve the right to verify refund claims and may request documentation of contact attempts.

7. Acceptable Use

You agree not to:

• Resell, redistribute, or share prospect information with third parties
• Use business opportunities for purposes other than legitimate real estate transactions
• Misrepresent your identity, credentials, or affiliation
• Attempt to access business opportunities assigned to other realtors
• Use automated scripts to scrape or extract data from the platform
• Violate any applicable real estate regulations or fair housing laws
• Send unsolicited bulk communications using prospect data
• Use the Service for any illegal or unauthorized purpose

8. Data Accuracy

While we employ advanced verification methods including AI-powered intent analysis and multi-source data validation, we do not guarantee the absolute accuracy of all prospect information. Prospect data is provided on an "as-is" basis and may contain occasional inaccuracies.

You should independently verify critical information before entering into any transaction or making significant business decisions based on prospect data.

9. Intellectual Property

The Service, including its design, features, content, algorithms, and proprietary technology, is owned by BROAD BUSINESS and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code.

10. Limitation of Liability

To the maximum extent permitted by law, BROAD BUSINESS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of or inability to use the Service.

Our total liability for any claims under these Terms shall not exceed the amount you have paid to BROAD BUSINESS in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless BROAD BUSINESS, its officers, directors, employees, and realtors from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Termination

We may terminate or suspend your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service will immediately cease, and any remaining prospect credits will be forfeited.

You may terminate your account at any time by contacting our support team. Starter accounts can be deactivated immediately. Paid accounts require 30 days written notice.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Los Angeles County, California.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on the Service. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

15. Messaging Terms

Business Identity & Expected Messages

By opting in, you agree to receive text messages from Broad Leads LLC. Messages include account updates, appointment reminders, promotional offers, and service updates related to our real estate business acquisition platform.

Opt-Out & Support Mechanisms

You can cancel the SMS service at any time. Just text "STOP" to the [Phone Number]. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again. If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at support@broadleads.com or (888) 555-LEAD.

Carrier Liability

Carriers are not liable for delayed or undelivered messages.

Message Frequency & Rates

As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive 2-4 messages per week. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
